Acceptable Use Policy (AUP)
Effective Date: November 21, 2025
This Acceptable Use Policy (“AUP”) governs the use of The Buzz CRM platform and related services (the “Services”) provided by International Web Marketers, LLC d/b/a The Buzz CRM (“The Buzz CRM,” “we,” “us,” or “our”).
This AUP is incorporated by reference into your primary agreement with us (the “Agreement”).
By accessing or using the Services, you (“Customer,” “you,” or “your”) agree to comply with this AUP and to ensure all of your users, sub-accounts, clients, employees, contractors, and anyone accessing the Services through your account (“End Users”) comply as well.
If you do not agree, you must not use the Services.
1. Scope & Responsibility
1.1 Applicability
This AUP applies to all components of the Services, including:
- CRM, automations, workflows, pipelines, landing pages, websites, and forms;
- Email, SMS/MMS, voice, voicemail drops, chat, and messaging tools;
- AI agents, automations, prompts, and content-generation features;
- APIs, webhooks, integrations, and any infrastructure we provide or manage.
1.2 Responsibility for End Users
You are fully responsible for all activity under your account and for ensuring End Users comply with this AUP.
1.3 No Circumvention
You may not attempt to bypass, disable, or defeat any compliance, rate-limit, or security control implemented to protect the platform or its users.
2. Lawful Use Only
2.1 Compliance
You must use the Services in full compliance with all applicable laws, including but not limited to:
- CAN-SPAM, CASL, GDPR, CCPA/CPRA, and other privacy laws;
- TCPA, TSR, CTIA guidelines, carrier rules, and A2P 10DLC requirements;
- Consumer marketing, advertising, and truth-in-advertising laws;
- Export controls, sanctions regulations, and local jurisdictional laws.
2.2 Global Responsibility
You are responsible for compliance in all jurisdictions where:
- You operate;
- Your End Users operate;
- Your communications are received.
We do not provide legal advice or represent that your use of the Services makes you compliant.
3. Prohibited Content
You may not use the Services to create, store, transmit, promote, or process content that is:
3.1 Illegal or Harmful
- Unlawful under federal, state, or local laws;
- Facilitating criminal activity;
- Involving controlled substances, weapons, or regulated services without proper authorization.
3.2 Abusive or Hateful
- Harassing, threatening, defamatory, or intended to intimidate;
- Targeting protected groups with hate, violence, or discrimination.
3.3 Sexual or Adult
- Any sexual content involving minors;
- Non-consensual adult content;
- Any adult content prohibited by carriers, regulators, or laws applicable to your jurisdiction.
3.4 Infringing or Unauthorized
- Violating any intellectual property, publicity, or privacy rights;
- Using trademarks, images, or content without permission.
3.5 Fraudulent or Deceptive
- False, misleading, or deceptive marketing or claims;
- Phishing, scams, financial fraud, pyramid or ponzi schemes;
- Misrepresentation of identity or sender information.
3.6 Malicious or Harmful
- Malware, ransomware, spyware, viruses, or harmful code;
- Attempts to compromise systems, data, or infrastructure.
4. Prohibited Activities
4.1 Unsolicited Communications & Spam
You may not:
- Send messages to recipients who have not provided valid consent;
- Use purchased, scraped, rented, or third-party lists without lawful consent;
- Ignore or delay honoring opt-out requests;
- Engage in snowshoeing, number rotation to evade filtering, or abusive sending practices.
4.2 Violations of Email, SMS, Carrier, and Voice Rules
You may not:
- Send messages without required disclosures or opt-out instructions;
- Fail to maintain compliant “Do Not Contact” lists;
- Use content disallowed by carriers (e.g., SHAFT restrictions where applicable).
4.3 Misuse of AI
You may not use AI tools provided through the Services to:
- Generate illegal, deceptive, defamatory, harassing, or prohibited content;
- Create deepfakes or impersonations intended to mislead, harm, or defraud;
- Produce regulated professional advice (legal, medical, financial, etc.) without proper disclosures.
4.4 Security Violations
You may not:
- Attempt unauthorized access to any account, system, or data;
- Perform penetration testing, scanning, or probing without written permission;
- Engage in DoS/DDoS or disrupt system availability or performance.
4.5 Platform Abuse
You may not:
- Cause excessive API usage or automation loops that degrade platform performance;
- Use the Services as a generic storage or hosting service unrelated to CRM or marketing operations;
- Resell or sublicense access in violation of your Agreement with us.
4.6 Reverse Engineering
You may not reverse engineer, decompile, disassemble, or attempt to derive source code unless permitted by law.
5. Customer Obligations
5.1 Account Security
You must:
- Safeguard logins, passwords, and API keys;
- Enable MFA where supported;
- Promptly report any suspected unauthorized access.
5.2 Sender Identification & Consent Records
You must:
- Clearly identify the sender where required;
- Maintain verifiable consent records;
- Track and honor opt-outs appropriately.
5.3 Content & Data Ownership
You are solely responsible for all content and data submitted by you or your End Users.
5.4 Third-Party Integrations
You must comply with all terms and policies of third-party tools you integrate with the Services.
6. High-Risk & Regulated Use Cases
6.1 Prohibited High-Risk Uses
You may not use the Services in any environment where failure of the Services could result in death, injury, or catastrophic harm.
6.2 Regulated Verticals
If you operate in a regulated industry (e.g., healthcare, finance, legal, cannabis), you are responsible for complying with all regulations governing your content and communications.
7. Monitoring, Enforcement & Remedies
7.1 Monitoring Rights
We may (but are not obligated to) monitor usage, message metadata, and campaign patterns to detect abuse, high complaint rates, or violations.
7.2 Enforcement Actions
We may take any action we deem necessary if you violate this AUP, including:
- Issuing warnings or requiring corrective actions;
- Throttling, filtering, or blocking traffic or campaigns;
- Suspending or terminating access to specific features or the entire account;
- Notifying carriers, partners, law enforcement, or affected third parties.
7.3 No Refunds
Suspensions or terminations due to AUP violations do not entitle you to refunds or credits.
7.4 Indemnification
You agree to indemnify and hold harmless The Buzz CRM and its affiliates from any claims, fines, penalties, losses, or liabilities arising out of your or your End Users’ violations of this AUP.

You must provide all reasonably requested information to assist in our investigation.
9. Changes to this AUP
We may update this AUP at any time. Updates are effective upon posting or upon notice through the Services or email. Continued use of the Services constitutes acceptance of the updated AUP.
10. Governing Law & Jurisdiction
This AUP and any disputes arising from it are governed by the laws of the State of Florida, with exclusive jurisdiction in Broward County, Florida.
11. Relationship to Other Terms
If there is a conflict between this AUP and the Agreement, the Agreement controls unless this AUP imposes more specific restrictions—in that case, this AUP governs.
